Sale of Fireworks

Sales of Fireworks
- Each site that fireworks are sold shall register with the Murray Fire Department and the Kentucky State Fire Marshal's Office
- Must register at least 15 days prior to the start of sales
- Registration fees are:
◦ $25.00 - Ancillary sales facilities
◦ $100.00 - Seasonal sales facilities (between June 10 and July 7 and December 26 and January 4)
◦ $250.00 - Permanent sales facilities - Sales facilities shall pass a fire inspection and pay the corresponding fee
- Each sales facility shall have its state and local registration displayed in a conspicuous place
- Sales staff shall be at least 18 years of age
Storage of Fireworks
- The storage of fireworks shall be reported in writing to the City of Murray Fire Marshal and the Kentucky State Fire Marshal using the appropriate forms (included in the Fireworks Packet).
- The initial report shall be submitted 15 days before storage begins
- Permanent facilities shall update their storage report annually
- Storage facilities shall pass a fire inspection and pay the corresponding fee
Failure to Comply
- Failure to register sales or storage facilities shall result in the closing of the sales or storage facility
- Fireworks held, sold, or stored in violations of KRS 227.700-750 shall be seized
- Fines;
◦ $25.00 - Use of ground or handheld devices by minors without adult supervision
◦ $25.00 - Use of ground or handheld devices within 50 feet of a structure
◦ $25.00 - Use or possession of aerial devices or audible ground devices by persons under of 18 years of age
◦ $25.00 - Use of aerial devices or audible ground devices within 200 feet of a structure or vehicle
◦ $100.00 - Failure to register ancillary sales facilities
◦ $250.00 - Failure to register seasonal sales facilities
◦ $500.00 - failure to register permanent sales facilities
◦ $500.00 - Failure to submit storage facility report
◦ $1000.00 - Sales or use of Display fireworks in violation of KRS 227.710
◦ $1000.00 - Failure to obtain local or state permit for Public display of fireworks, Pyrotechnic displays before a proximate audience and flame effects before a proximate audience
Use of Fireworks
- Ground or handheld devices (emits showers of sparks or flashes
of light only)
◦ Those under 18 yrs of age shall be supervised by an adult
◦ Fireworks shall not be ignited within 50 ft of structures or vehicles - Arial devices or audible ground devices (fly, spin, report or
explode)
◦ Must be 18yrs of age to use
◦ Fireworks shall not be ignited within 200 ft of structures or vehicles
Public Display of Fireworks
- Local and state permits required for
◦ Public Displays of Fireworks
◦ Pyrotechnic Displays in Front of a Proximate Audience
◦ Flame Effects in Front of a Proximate Audience - Permit applications shall be filed with the City of Murray Fire Marshall at least 15 days prior to display date
- Permit applications filed less than 15 days prior to display date shall be assessed a $100.00 fee
- Displays shall be compliant with;
◦ NFPA 1123 - Code for Fireworks Display
◦ NFPA 1124 - Code for the Manufacture, Transportation, Storage and Retail Sales of Fireworks and Pyrotechnic Articles
◦ NFPA 1126 - Standard for the use of Pyrotechnics Before a proximate Audience
◦ NFPA 160 - Standard for the use of Flame Effects Before an Audience - Proof of insurance or a bond in the amount of $1,000,000 shall be provided prior to receiving a permit for public displays
- Display operator must be licensed by the ATF
- During displays anyone remaining within the fallout area shall
be:
◦ ATF Licensed display operator
◦ An employee of the display operator
◦ An assistant in training
◦ At least 18 yrs of age
